Statement: «Stop the Congresses on Reproductive Exploitation of Women and Trade in Newborns organised in the Basque Country from taking place»

Ante la inminente celebración en el País Vasco (España) de dos congresos que PUBLICITAN la mal llamada “gestación subrogada”, las siguientes organizaciones feministas emitimos el siguiente comunicado para el que os pedimos vuestra adhesión:

NOTA DE REDACCION: El Congreso, que tendrá lugar los días 16, 17 y 18 de junio, estará liderado y coordinado por el Centro de Fertilidad Bilbao junto al Dr. Guillermo Gauthier y el Dr. Javier Peña. En él, la asociación vizcaína Gure Umeen Ametsak realizará ponencias sobre maternidad subrogada como técnica de reproducción asistida. Una técnica que los colectivos feministas han denunciado al considerar que «promueve la compra y venta de bebés mediante la explotación reproductiva».

NOSOTRAS, MUJERES FEMINISTAS, CIUDADANAS DEL ESTADO ESPAÑOL Y DEL MUNDO:

📢 DENUNCIAMOS el incumplimiento en el Estado español de la Ley de Salud Sexual y Reproductiva y de la Interrupción Voluntaria del Embarazo en relación con la explotación reproductiva de mujeres y el comercio de seres humanos recién nacidos.

👉Una ley que, en línea con el Convenio de Estambul, define la gestación subrogada como una vulneración grave de los derechos reproductivos y una manifestación de violencia contra las mujeres, siendo una forma grave de violencia en el ámbito de la salud sexual y reproductiva de las mujeres, equiparable a la esterilización y la anticoncepción forzosas y al aborto forzoso. (Preámbulo, epígrafe II, párrf. 8)

👉Una ley que refuerza la nulidad de pleno derecho de los contratos de subrogación y la ilegalidad de la gestación por sustitución establecida en la Ley 14/2006, de 26 de mayo, sobre técnicas de reproducción humana asistida.

👉Una ley que prohíbe la publicidad de las agencias de intermediación, y prevé campañas institucionales de promoción e información sobre la ilegalidad de esta práctica. (Art. 32)

👉Una ley que prohíbe la promoción comercial de la gestación por sustitución, y que afirma que en coherencia con lo establecido en la Ley General de Publicidad 34/1988, las administraciones públicas instarán la acción judicial dirigida a la declaración de ilicitud de la publicidad que promueva las prácticas comerciales para la gestación por sustitución y a su cese. (Art. 33)

👉 Una ley que recoge medidas de prevención y respuesta frente a formas de violencia contra las mujeres en el ámbito de la salud sexual y reproductiva, previendo, en particular, actuaciones dirigidas a la prevención de la gestación por subrogación o sustitución. (Capítulo III)

👉 Una ley que prevé campañas que desmitifiquen todas las formas de violencia en el ámbito reproductivo, como la gestación por sustitución. (Artículo 10 quinquies)

📢 DENUNCIAMOS la inacción de las administraciones públicas, gobierno estatal y autonómico del País Vasco, poder judicial y partidos políticos estatales y autonómicos ante la organización en el País Vasco de los siguientes eventos de promoción comercial y defensa de la gestación subrogada por parte del lobby de la industria médico reproductiva y de los compradores:

– XVI Congreso de ANACER, los días 16 y 17 de junio de 2023, en Bilbao.
– I Congreso internacional “Mujeres y gestación por sustitución”, los días 20 y 22 de julio de 2023, también en Bilbao.

No olvidemos que esta práctica está tipificada como delito en nuestro ordenamiento jurídico; por lo tanto, estos eventos deberían ser ilegales en nuestro país.

📢 DENUNCIAMOS que ningún partido político con representación en el gobierno estatal y/o autonómicos está tomando cartas en el asunto ante los continuos ataques, acoso y presiones del lobby de compradores de bebés y de la industria de la medicina reproductiva, que actúan con el único fin de legalizar en nuestro país esa forma de VIOLENCIA GRAVE contra las mujeres que es la gestación subrogada.

📢 DENUNCIAMOS a los partidos políticos como EH Bildu, Ciudadanos, PNV y ERC por pretender la legalización de la gestación subrogada, a los partidos que mantienen una posición ambigua o diletante y a cuantos se muestran a favor de esta práctica violenta a título individual desde partidos o plataformas políticas, olvidando que esta práctica es siempre explotación reproductiva, en la que una mujer sana es sometida a tratamientos médicos y farmacológicos que no solo no necesita para su propia salud, sino que incluso ponen en riesgo su vida. Les recordamos a todos ellos que los derechos humanos solo se pueden cumplir y defender en el marco de los derechos humanos, y que la gestación subrogada es por definición venta de niñas y niños a los ojos del Derecho Internacional de los Derechos Humanos.

📢 Finalmente, DENUNCIAMOS AL GOBIERNO DE ESPAÑA, supuestamente el más feminista de la historia, y sus partidos de coalición, PSOE y Unidas Podemos, por su falta de voluntad política y por haber perdido la oportunidad histórica:

👉 De anular la instrucción 2010 de la DGRN que supone un fraude de ley y la legalización de facto de la explotación reproductiva en nuestro país,

👉 De impulsar a nivel mundial, junto al resto de países demócratas europeos y prohibicionistas, una Convención Internacional contra la Gestación Subrogada, como instrumento jurídico superior capaz de proteger a las mujeres y a sus hijas e hijos de las fuerzas del mercado y la industria de la reproducción asistida.

In view of the imminent celebration in the Basque Country (Spain) of two congresses that ADVERTISE the misnamed «surrogacy», the following feminist organisations issue the following communiqué for which we ask for your support:

WE, FEMINIST WOMEN, CITIZENS OF SPAIN AND THE WORLD:

📢 WE DENOUNCE the non-compliance in the Spanish State of the Law on Sexual and Reproductive Health and the Voluntary Interruption of Pregnancy in relation to the reproductive exploitation of women and the trade in newborn human beings.

– A law that, in line with the Istanbul Convention, defines surrogacy as a serious violation of reproductive rights and a manifestation of violence against women, being a serious form of violence in the field of women’s sexual and reproductive health, comparable to forced sterilisation, forced contraception and forced abortion (Preamble, epigraph II, para. 8).

– A law that reinforces the nullity of surrogacy contracts and the illegality of surrogacy established in Law 14/2006 of 26 May on assisted human reproduction techniques.

– A law prohibiting the advertising of surrogacy agencies, and providing for institutional promotion and information campaigns on the illegality of this practice. (Art. 32)

– A law prohibiting the commercial promotion of gestational surrogacy, and stating that in coherence with the provisions of the General Advertising Law 34/1988, the public administrations shall initiate legal action aimed at the declaration of the illegality of advertising that promotes commercial practices for gestational surrogacy and its cessation. (Art. 33)

– A law that includes measures of prevention and response to forms of violence against women in the field of sexual and reproductive health, providing, in particular, actions aimed at the prevention of surrogacy (Chapter III).

– A law providing for campaigns demystifying all forms of violence in the reproductive field, such as surrogacy (Article 10 quinquies).

📢 WE DENOUNCE the inaction of the public administrations, state and autonomous government of the Basque Country, the judiciary and state and autonomous political parties in the face of the organisation in the Basque Country of the following events of commercial promotion and defence of surrogacy by the lobby of the medical reproductive industry and the buyers:

– XVI ANACER Congress, on 16 and 17 June 2023, in Bilbao.
– 1st International Congress «Women and Surrogate Gestation», on 20 and 22 July 2023, also in Bilbao.

Let us not forget that this practice is classified as a crime in our legal system; therefore, these events should be illegal in our country.

📢 We DENOUNCE that no political party with representation in the state and/or autonomous
government is taking action in the face of the continuous attacks, harassment and pressures from the lobby,
harassment and pressure from the baby-buying lobby and the reproductive medicine industry, who act with the aim of reproductive medicine industry, who are acting with the sole purpose of legalising in our country this form of SERIOUS VIOLENCE against women that is surrogacy.

📢 We DENOUNCE political parties such as EH Bildu, Ciudadanos, PNV and ERC for seeking the legalisation of surrogacy, parties that maintain an ambiguous or dilettante position and those who are in favour of this violent practice as individuals from political parties or platforms, forgetting that this practice is always reproductive exploitation, in which a healthy woman is subjected to medical and pharmacological treatments that not only she does not need for her own health, but that even put her life at risk. We remind all of them that human rights can only be fulfilled and defended within the framework of human rights, and that surrogacy is by definition the sale of children in the eyes of international human rights law.

📢 Finally, WE DENOUNCE THE GOVERNMENT OF SPAIN, supposedly the most feminist in history, and its coalition parties, PSOE and Unidas Podemos, for their lack of political will and for having missed the historic opportunity:

– Of annulling the 2010 instruction of the DGRN that supposes a fraud of law and the de facto legalisation of reproductive exploitation in our country,

– To promote at a global level, together with the rest of the European democratic and prohibitionist countries, an International Convention against Surrogacy, as a superior legal instrument capable of protecting women and their daughters and sons from the market forces and the assisted reproduction industry.
